Man that summary at the top was throwing me off for like 2 minutes. He says its all because they changed the stats of an "imaginary" gun. I thought this meant that in the patch notes they said they modified the stats of a gun that didn't exist in-game in the first place. But no, by "imaginary", he means "virtual"... its a gun that DOES EXIST in the game. It isn't "imaginary". I hate when people use that word like that.

No, it won't be in the public domain until 70 years after its "author" dies (dunno who that'd be in the case of a game). So probably not until at least like 2100. It's "abandonware," which is legally meaningless but basically boils down to "well, it's old and the studio that made it ain't around, so no one's likely to object if you pirate it"

Well basically Microsoft stopped supporting it over a decade ago with the death of MS Kids and MS Home. They are also not selling it anywhere and since there is no profit to be made from it, the one trademark holder will not give a flying fuck. The trademark has most likely expired in 2005 anyway. The only ones caring would probably the developer who created the content... but that was under contract from MS Kids so that MEANS NOTHING!

Edit: I actually highly doubt that they ever trademarked those games. The database of U.S. trademarks doesn't list 3D Movie Maker, only McZee whose trademark has been cancelled in 2003:

trademark =/= copyright. in the USA, copyright is automatic on any creative work whether you "register" it in any way or not.

People worked under contract for Microsoft, making MS the owner.
MS abandoned all their Home/Kids products and cancelled all the trademarks, they didn't even let them expire because they firstly don't want to support it anymore and secondly have no interest in going back to it. They would never ever turn 180° and suddenly interfere with anything happening to the program. This is nothing of their interest, nothing of their concern. They thought the software was a failure. Copyright law wise someone has to own it. But MS abandoned all the shit they could on paper. So what?
I wasn't trying to say that "legally it is free" or someshit but I was trying to make the point that MS has for over a decade abandoned the program in every way possible. They would not care.

The term abandonware means nothing at all to me. It's a fishy word used by people to make them downloading a game that hasn't been sold for a long time seem legal.

My point is that what is with 3dmm is nothing of their interest. NULL, ZERO.
It is old as shit software, that failed, made by a fishy sub section of Microsoft.
They don't want to have to do anything with it.

To avoid confusion, I never meant to say that this means it's public domain, freeware or 'abandonware'

It officially is NOT.
But no one is seriously gonna bother. Not today.

Having an automatic copyright law doesn't mean that the copyright holder is automatically concerned about his product. Obviously you can't do anything about the copyright thing but I can tell you for sure that MS = zero interested.
